Mediation is for those wanting a controllable and cost-effective way of resolving the disagreements which can arise from relationships that have broken down - without the need for a Court to be involved.

Mediation involves an independent third party - a mediator - who helps both parties where communication has broken down to achieve agreement wherever possible. Through a structured process mediators encourage parties to reach practical proposals for property, finance, and parenting of children.

Even if agreement cannot be achieved, family mediation often helps communication and better management of volatile and complicated situations.

Relationship breakdown can be painful, often involving lawyers - who acting for only one side - are likely to focus on doing everything to protect their client's interests, as opposed to:

  • trying to minimise domestic warfare,
  • helping to sort out traumatic family situations
  • drawing a line under the past.

    Where a relationship might be saved FMIS can make a referral to relationship counselling, or to other organisations when appropriate.

    Mediation can assist in helping parties decide on the timing of a separation or divorce. The procedure and cost of divorce can also be considered.
